These Terms of Service ("Terms") govern your use of hirevirtualsupport.com and any related pages, forms and content (the "Site") operated by Go Virtual LLC ("Go Virtual," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are and what the Site is for

Go Virtual is a Commerce-as-a-Service company that provides outsourced ecommerce operations, marketing, marketplace, customer experience, analytics and related services to businesses. The Site describes our services and lets businesses contact us, request a diagnostic and read our content. The Site is intended for business use by people 18 or older.

2. Client engagements are governed by a separate agreement

Nothing on the Site is an offer to provide services. Any services we provide are governed by a separate written agreement, such as a master services agreement and statement of work, signed by you and Go Virtual. If those documents conflict with these Terms, the signed agreement controls for the services it covers. Pricing, fee structures, growth-share arrangements, timelines and results described on the Site are general information only and become binding only when set out in a signed agreement.

3. Information you submit

When you submit a form, email us or book a call, you agree that the information you provide is accurate and that you are authorized to share it, including on behalf of the business you represent. Please do not send us confidential, sensitive or regulated information through the Site; if confidentiality is needed, we will put an appropriate agreement in place first. Our Privacy Policy explains how we handle personal information.

4. Acceptable use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • submit false, misleading or spam enquiries, or impersonate anyone;
  • attempt to gain unauthorized access to the Site, our systems or other users' information;
  • introduce malware, or interfere with the security or operation of the Site;
  • scrape, harvest or copy Site content in bulk by automated means, except for standard search engine indexing.

5. Intellectual property

The Site and its content, including text, graphics, logos, page designs and the Go Virtual name, are owned by Go Virtual or its licensors and protected by intellectual property laws. You may view and share Site pages for your own business evaluation. You may not reproduce, modify, distribute or create derivative works from Site content for commercial purposes without our written permission. Ownership of work product created during a client engagement is addressed in the signed client agreement.

6. Content is general information, not professional advice

Articles, guides, benchmarks and other content on the Site are provided for general information. They are not legal, tax, financial or accounting advice and may not fit your situation. Examples and results described on the Site are illustrative and are not a promise of future results.

7. Third-party links and services

The Site may link to or rely on third-party websites and services, including Shopify, which hosts the Site. We are not responsible for third-party content, products or practices, and your use of them is subject to their own terms.

8. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, GO VIRTUAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GO VIRTUAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). This section does not limit liability under a signed client agreement, which sets its own terms.

10. Indemnity

You agree to indemnify and hold harmless Go Virtual and its members, employees and contractors from claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. Disputes under a signed client agreement are resolved as that agreement provides.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the "Last updated" date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Go Virtual about your use of the Site.
